Welcome to White Cap Solutions. These Terms of Service ("Terms") govern your access to and use of the web hosting, domain registration, website design, and consulting services (collectively, the "Services") provided by White Cap Solutions ("we," "us," or "our").
By purchasing, accessing, or using our Services, you agree to be bound by these Terms, as well as our Acceptable Use Policy (AUP) and Privacy Policy.
1. Description of Services White Cap Solutions provides digital infrastructure and consulting for businesses.

Hosting: We provide server space and resources as outlined in your specific hosting plan (The Essential, The Builder, or The Enterprise).

Domains: Domain registration services are provided through our third-party registrar partners and are subject to the rules and policies of the Internet Corporation for Assigned Names and Numbers (ICANN).

Design & Consulting: Custom web development and consulting projects may be subject to a separate, specific Statement of Work (SOW) or contract.
2. Billing, Payments, and Auto-Renewal

Subscriptions: Hosting services are billed on a recurring subscription basis (monthly or annually) paid in advance.

Auto-Renewal: To prevent service interruption, your hosting and domain renewals will automatically process using the payment method on file unless canceled prior to the renewal date.

Domain Non-Refundability: Once a domain name is registered or renewed, the fee is strictly non-refundable, as the registration is immediately logged globally.

Failed Payments: If a payment fails, we will attempt to notify you. Failure to update payment information within the specified grace period may result in service suspension or account termination.
3. Client Responsibilities

Account Security: You are responsible for maintaining the confidentiality of your login credentials, Plesk control panel, and client portal access.

Accurate Information: You must provide accurate, current billing and contact information.

Compliance: You agree to use our Services only for lawful purposes and in strict accordance with our Acceptable Use Policy (AUP).
4. Data Backups and Loss While White Cap Solutions performs routine server-level backups for disaster recovery purposes, you agree that you are ultimately responsible for maintaining your own independent backups of your website content, databases, and emails. We are not liable for any data loss, corruption, or hardware failure.
5. Intellectual Property

Your Content: You retain full ownership and intellectual property rights to all data, text, logos, and materials you upload to your hosted website.

Our Infrastructure: White Cap Solutions retains ownership of our proprietary server configurations, custom software, and underlying hosting infrastructure.
6. Limitation of Liability and Warranties Our Services are provided on an "as-is" and "as-available" basis. White Cap Solutions makes no warranties, expressed or implied, regarding the continuous, uninterrupted availability of the Services.
To the maximum extent permitted by law, White Cap Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Services. In no event shall our total liability exceed the amount you paid to us for the specific Service in the three (3) months preceding the claim.
7. Cancellation and Termination

By You: You may cancel your hosting services at any time via your client portal. Cancellations will take effect at the end of your current paid billing cycle.

By Us: We reserve the right to suspend or terminate your access to the Services immediately, without notice or refund, if you violate these Terms or our Acceptable Use Policy (AUP).
8. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State in which White Cap Solutions operates, without regard to its conflict of law provisions.
